01Agreeing to these terms
These Terms of Service ("Terms") are an agreement between you and Bleed Independent Technology ("Bleed", "we", "us"), the independent business behind bleed.one, B1o, C2o and any related websites, apps and APIs (together, the "Services"). Bleed is run by a private individual as a sole proprietorship based in Calw, Germany; full details are in our legal notice.
By joining the waitlist, creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
If you use Bleed on behalf of an organization, you confirm that you're allowed to accept these Terms for it, and "you" includes that organization. If you don't agree, please don't use the Services.
02Who can use Bleed
You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, to use the Services. To buy a paid plan you must be at least 18, or have permission from a parent or guardian. You can't use the Services if applicable law prohibits you from doing so.
03Your account
Give us accurate information and keep your login details secure. You're responsible for everything that happens on your account. If you think someone else has accessed it, tell us right away at support@bleed.one. Unless your plan says otherwise, each account is for one person.
04Using B1o and C2o
We give you a personal, non-exclusive, non-transferable and revocable right to use the Services in line with these Terms.
Before and shortly after launch, some features may be offered as a preview, beta or waitlist release. Pre-release features can change, break or be removed, and may come with usage limits.
05Acceptable use
You agree not to use the Services to:
- break any law or anyone else's rights, including privacy and intellectual-property rights;
- create content that is fraudulent, defamatory, harassing or hateful, that sexualizes minors, or that promotes violence;
- impersonate a real person or organization, run scams or phishing, or send spam or deliberate misinformation;
- build malware, or access systems or data you don't have permission to access;
- submit AI-generated work where the rules forbid it (for example in an exam, a class, a job application or a publication), or otherwise use outputs to deceive someone in a way that harms them;
- reverse engineer, scrape or overload the Services, get around usage limits or safety measures, or use outputs to build a competing model;
- resell or share access to the Services without our written permission.
We may investigate suspected violations and take action, including removing content or suspending accounts.
06Your content and outputs
You keep ownership of the prompts, messages, files and code you submit ("Inputs"). As between you and Bleed, and to the extent the law allows, you own the content the Services generate for you ("Outputs").
You give us a limited license to host, process and display your Inputs and Outputs only as needed to run, secure and support the Services, as described in our Privacy Policy. You confirm you have the rights needed to submit your Inputs.
Outputs may not be unique: other people may receive similar results, and you don't get rights to theirs.
07AI outputs can be wrong
B1o and C2o generate content automatically. Outputs can be inaccurate, incomplete or unsuitable for your purpose, and generated code can contain bugs or security issues. Review, test and verify outputs before you rely on them, especially code you deploy and anything legal, medical, financial or safety-related. Outputs are not professional advice.
08Plans, payment and renewals
Some features need a paid plan. Prices and what each plan includes are shown before you pay. Subscriptions renew automatically at the end of each billing period until you cancel.
You can cancel at any time from your account settings, and you'll keep access until the end of the period you've already paid for. Payments are handled by our payment provider; we never store your full card number. Refunds are covered by our Refund Policy.
We may change prices with at least 30 days' notice. New prices apply from your next billing period.
09Our intellectual property
The Services, including the Bleed name and logo, B1o, C2o, our software, models and website, belong to Bleed and its licensors. These Terms don't give you any right to our brand or technology beyond using the Services. If you send us feedback or ideas, we may use them without any obligation to you.
10Suspension and termination
You can stop using the Services and delete your account at any time. We may suspend or end your access if you break these Terms, if your use puts us or others at risk, or if we discontinue the Services. Where reasonable, we'll give you notice and a chance to export your content first. Sections that by their nature should survive termination will survive.
11Disclaimers
Your statutory warranty rights apply. Beyond them, we don't promise that the Services will always be available, uninterrupted or error-free, or that outputs will be accurate or fit a particular purpose. Pre-release features are provided for testing and may not work as expected.
12Limitation of liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we are only liable if we breach an essential contractual obligation, meaning an obligation that makes proper performance of the contract possible in the first place and that you can regularly rely on. In that case our liability is limited to the damage that is typical and foreseeable for this kind of contract. Otherwise, liability for slight negligence is excluded.
13Indemnity
If you use the Services for a business, you'll defend and indemnify Bleed against third-party claims arising from your Inputs, your use of Outputs, or your breach of these Terms.
14Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you're a consumer living in the EU, you also keep the protection of the mandatory consumer laws of your country.
If you're a merchant, a legal entity under public law or a special fund under public law, the courts competent for Calw, Germany have exclusive jurisdiction. Before going to court, please contact us so we can try to resolve things informally.
15Changes to these terms
We may update these Terms as the Services evolve. If a change is material, we'll let you know by email or in the product at least 14 days before it takes effect. If you don't agree, you can cancel before the change applies; if you keep using the Services after that, you accept the updated Terms.
